Terms Of Use of hottakes

Please read carefully and make sure you fully understand the contents of the following Terms of Use.

By opening an account with HotTakes you are entering into an agreement with 12652803 Canada Inc., doing business as ‘HotTakes Sports’, https://www.hottakesapp.com. The following Terms and Conditions are those binding to that agreement.

In no event shall HotTakes, its software providers, its officers, directors, employees, affiliates or agents be liable for any indirect, incidental, special, consequential or punitive damages (including without limitation, lost profits or income, or loss of use of equipment, software, opportunity or data) related to or that arise from:

  • your use of or inability to use this web site or the materials,

  • any failure or malfunction or any software, hardware, communication, broadcasting, technology, or other system,

  • your reliance on any materials contained on this Web site, or

  • any goods or services advertised or linked to this web site, even if HotTakes is aware of the possibility of such damages, acted negligently, or if the exclusive remedies stated herein fail in their essential purpose.

1. Account Eligibility

To become a member of HotTakes, and use the downloadable application(s) you must be of the legal Age of Majority in their residential province or state.

HotTakes reserves the right to request proof of age documentation from any customer at any time. Players identified as underage will forfeit their ability to claim prizes.

Only one HotTakes account is permitted per person, or per computer environment. A 'computer environment' is one where multiple computers are on the same server or network. It can also refer to a sequence of IP addresses registered to the same host. A player can register using a PO Box number but it must be part of their residential address that can be independently verified. The PO Box must be accompanied by a street address, rural route or service road number.

By accepting these Terms and Conditions when opening an account and/or logging into your existing account via the website and/or downloadable application(s); you hereby agree that we shall be entitled to conduct, from time to time, any and all such identification, credit and other verification checks; that we may require, and/or are required by applicable laws and regulations, and/or by the relevant regulatory authorities for use of the Website and/or downloadable application(s) and our products generally.

2. Compliance with Laws

It is your sole responsibility to ensure that your participation in any games offered on the HotTakes website and and/or downloadable application(s) complies with all laws applicable in your province. HotTakes, its agents and its affiliates accept no liability for any losses, damages, costs or legal consequences that you may incur as a result of your participation in any games offered on the HotTakes website and/or downloadable application(s).

Members shall not use HotTakes for professional purposes. Members warrant that their use of HotTakes is solely for personal entertainment and acknowledge that any activities outside the intended use are strictly prohibited. Any illegal or suspicious activities by members may be reported to the relevant law enforcement authorities.

3. Account Disputes

Every attempt will be made to facilitate appropriate solutions between complainants and HotTakes. You also acknowledge and agree that any claim that in the event HotTakes has a claim against you, HotTakes may pursue such claim and commence a legal proceeding against you in the courts of any jurisdiction of our choosing.

Members are expected to abide by our Terms and Conditions and Rules at all times and accept that any breach could lead to penalties including but not limited to account suspension, and loss of prizes.

In the event of any dispute between a member and HotTakes, both parties shall refer to the data from HotTakes's servers as an accurate and indisputable record of the facts.

4. Restricting or Closing Accounts

A customer may wish to voluntarily restrict or close their account by contacting the HotTakes customer support at https://hottakesapp.com//contact/, or by sending an email to support@hottakesapp.com.

5. Changes in Terms

HotTakes reserves the right to suspend, modify, remove and/or add any service at its sole discretion with immediate effect and without notice and HotTakes will not be liable for any such action.

HotTakes may change, suspend or discontinue any aspect of https://www.hottakesapp.com/ and its services at any time, including the availability of any site features, broadcast, database, or content, where HotTakes has commercial or technical reasons to do so. HotTakes may also impose limits on certain features or services or restrict a member's access to parts or the entire site for similar reasons.

You fully understand and agree to be bound by these Conditions and our stated Rules and Regulations at all times and HotTakes reserves the right to change these at any time. Such changes shall have effect immediately upon publication on this site and you agree to be bound by them and to regularly review them for the purposes of monitoring such changes.

If any modification is unacceptable to you, your only recourse is to close your account with HotTakes. It is your sole responsibility to review these Conditions and any amendments. These Conditions and the documents referred to herein represent the complete and final Conditions agreed between you and HotTakes in relation to these Terms and Conditions and supersede any and all prior agreements between you and HotTakes.

In addition to these General Terms and Conditions and the Rules, HotTakes may publish additional terms of business and house rules to accompany special and/or one-off promotions, contests and tournaments. HotTakes may cancel its promotions, contests and tournaments at any time. Any issues arising from errors or omissions in the rules governing these events will be reviewed by HotTakes management. Members agree that the decision of HotTakes management in such matters is final and binding.

6. Trademarks and Intellectual Property

All trademarks, trade names, service marks and logos displayed throughout this website and/or downloadable application(s) are the property of HotTakes or licensed by third parties.

You may not display, use as a link, use as a meta tag, or otherwise use any of the trademarks, trade names, service marks and logos displayed throughout the site without the prior written consent of the owner of the trademark, trade name, service mark and logo.

Further, all other material used by HotTakes, including but not limited to the software, images, pictures, graphics, photographs, animations, broadcast content, videos, music, audio, text (and any intellectual property rights in and to any of the same) is owned or licensed by HotTakes or one of its subsidiaries or associated group companies and is protected by copyright and/or other intellectual property rights. You obtain no rights in such copyright material or trade or service marks and must not use them without written permission.

Nothing contained in these Terms and Conditions of Use shall be construed as conferring any license or right to any trademark or other intellectual property right of Company or any other party.

This website may contain links to third-party websites. These links are provided for convenience only. HotTakes does not endorse and is not responsible for the content of any third-party websites.

7. Limitation of Liability

HotTakes shall not, in any way, be responsible for any acts or omissions made by a member's Internet Service Provider ("ISP") or Telecommunications Service Provider ("TSP") with whom the user has contracted to gain access to this service, and HotTakes shall not be a party to any dispute between a member and its ISP or between a member and its TSP, nor shall any such dispute have any effect on a member's obligation to the Terms and Conditions.

HotTakes is not required to provide redundant or back up networks and/or systems.

To the fullest extent possible pursuant to applicable law, the site, all software used by it and the materials are provided on an "as is" and "as available" basis. HotTakes and its software providers expressly disclaim all warranties of any kind, whether express, implied or statutory including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that this web site or the materials are completely error-free, will operate without interruption, are compatible with all equipment and software configurations, free of viruses, errors, or other harmful components, or will otherwise meet your needs.

Computer systems are vulnerable in varying degrees to computer viruses, bugs, power disruptions, communication line disruptions, Internet access failures, Internet content failures, attacks by hackers and other problems. We have taken reasonable steps so that such problems will not materially affect our business, but do not guarantee that the Site is immune to such problems. It is your responsibility to protect yourself from such problems. Steps you may consider taking to mitigate the vulnerability of your computer system include using firewalls, password protection, and anti-virus programs.

8. Indemnity

You agree to indemnify, defend and hold harmless HotTakes, our third party service providers, our software providers, officers, directors, employees, agents, licensors, suppliers and any third-party information providers to, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account or that may arise out of or in connection with (a) any breach of these Terms by you or through a machine on which you access the Site; (b) any of your user-contributed content infringing these Terms or the rights of any person or entity; or (c) any purchase or other property-related transaction to which you are party or that is entered into in connection with this site.

9. Live Game Prediction Terms and Conditions

Participants in our live game prediction services accept that:

  • live game predictions are only available at scheduled times via the application,

  • HotTakes publishes schedules for live prediction events on its site and these schedules are subject to change without notice,

  • due attention should be paid to the data and rules being streamed during the course of any live event, and

  • live feeds are subject to latency issues and there may be times when live events become disrupted or inaccessible as a result of unavoidable technical difficulties.

10. Dormant Accounts

Your account will be considered dormant if it has not had any activity for 18 months. Account activity is defined as the following: making a game prediction, interacting with content from a separate User Account, entering into a Competitive Match, posting profile content.

11. Sign Up Bonus

HotTakes sign up bonuses are limited to new sign ups who are resident in Canada only, are offered on the basis of three times per person, household, account or computer environment, are valid for a maximum period of 90 days from the time of sign-up. HotTakes reserves the right to alter the validity period and/or the bonus offer at any time.

Customers who are eligible for a bonus streak but do not wish to have a bonus automatically credited to their account should notify HotTakes customer support before making their first pick after a streak bonus has been credited.

Players considered to be abusing the bonus system may have their streak bonuses, as well as any winnings from picks based on such bonuses, forfeited and be subject to further sanctions, at the sole discretion of the HotTakes management. HotTakes reserves the right to withdraw a streak bonus or hold ineligible any customer who does not meet these Terms and Conditions. 12. System Errors

Participants in our site services accept that in cases of SYSTEM ERRORS:

  • You must inform us as soon as you become aware of any errors with respect to your Account or any calculations with respect to any prediction you have placed.

  • In the event of any system failure or game error that results in an error in any odds calculation, streak bonuses or prize winnings, ('System Error'), We reserve the right to declare null and void any picks that were the subject of such System Error.

  • dn all circumstances whereby we determine a System Error has been used to gain an unfair advantage, we reserve the right to consider this activity to be subject to forfeiture and account closure.

13. Abusive or Offensive Behaviour

Abusive or offensive behaviour will not be tolerated on our platforms, with a community member, or any of our staff. Any violation of this policy will result in a suspension of your use of the services or such other action.

Prize Contest Terms and Conditions

Please read the agreement carefully and make sure you fully understand its contents. If you have any doubts about your rights and obligations resulting from the acceptance of this agreement, please consult a legal attorney.

Please read carefully the following legally binding agreement between 12652803 Canada Inc. under the brand name of HotTakes Sports and you.

1. Definitions

The following words and terms, when used with this agreement, shall have the following meanings, unless the context clearly indicates otherwise.

General Terms and Conditions – the entirety of this agreement and includes all of the terms and conditions set out in this agreement.

A 'household' includes the same geographic address, mailing address, deposit / withdrawal address. A 'computer environment' is one where multiple computers are on the same server or network. It can also refer to a sequence of IP addresses registered to the same host. The PO Box must be accompanied by a street address, rural route or service road number;

Privacy Policy – HotTakes’s Privacy Policy published on the HotTakes website and downloadable application(s): https://hottakesapp.com/privacy/ and includes such amendments, deletions and additions to the Privacy Policy as HotTakes may publish from time to time;

Rules – HotTakes’s rules regarding placing predictions and posting content published on the HotTakes website and downloadable application(s): https://hottakesapp.com//terms/ and includes such amendments, deletions and additions to the Rules as HotTakes may publish from time to time;

Software - the software owned by HotTakes or that is licensed to us by a third party including any program or data file or any other content derived therefrom, that is required to be downloaded, accessed or otherwise utilized by you from the Website and/or downloadable application(s) enabling you to participate in HotTakes services.

Username and Password - the username and password which you choose on registration with the application.

You - the user of the HotTakes software downloaded from the Website and/or downloadable application(s).

Us/We/Ours – HotTakes Sports, operated by 12652803 Canada Inc.;

Website - https://www.hottakesapp.com and any related sites accessible via links or any other access way;

2. Subject Matter of Agreement

This agreement covers the arrangements between you and us in relation to your use of the application.

3. Legal Requirements

3.1 You must inform us as soon as you become aware of any errors with respect to your Account or any calculations with respect to any prediction you have placed.

4. License to use software

We hereby grant to you a personal non-exclusive, non-transferable right to use the Software, for playing in the application, in accordance with the following provisions.

4.1 You are not permitted to:

4.1.1 Install or load the Software onto a server of other networked device or take other steps to make the Software available via any form of "bulletin board", online service or remote dial-in, or network to any other person;

4.1.2 Sub-license, assign, rent, lease, loan, transfer or copy (except as expressly provided elsewhere in this agreement), your license to use the Software or make or distribute copies of the Software;
